Hi,

The company I've been working for has no contracts in place. I did a subcontractors agreement which I copied from one my husband has, but I'm leaving them and they offered a friend the position. I need to get a contract done today, but can't find anything that I don't have to pay for. Does anyone know where I can find a copy? (I did contact the Employment Standards thingy in BC, but haven't heard back from them yet)

I've had three jobs since moving to Canada, and not one of them offered an employment agreement. They weren't contract jobs, though, just regular permanent/full time staff positions. Guess they reckoned workers are protected enough by the laws of the land.

Have you tried converting an SA employment agreement to the Canadian situation?

Yeah, I've seen that as well. It is just that the lady that will be working in this position is moving from Calgary, and we wouldn't want her to get to Vancouver and then they tell her sorry, no job. I also want to see that her hourly wage is in writing...

I will see if I can find a SA one. Mine is very complicated at best, so I don't even want to try and convert it.

What about a letter offering her the job and stating the salary? Keeps it as simple or as complicated as you like.

An employment contract really just needs to state the basic things, such as what the remuneration is, what the hours of work are, where the place of work is to be, who the person reports to, what the termination procedures are (although there are provincial and federal laws that govern this) and if the employment is for a set period of time, then what this duration is. The contract is formed either when the person returns the offer letter signed, or when the person arrives on Day 1 to take up the job. Things like benefits and payroll deductions do not need to be included in an employment contract - they can be dealt with separately, once the person has started working.

I'm running out of time here. This contract should have been at the employer at 2pm and I have NOTHING. I tried to mod my husband's, but it is full of immigration stuff and he is in a management position, so overtime isn't relevant, etc, etc. I'm not a lawyer. The employer has never before had any contracts. Mine was for subcontracting, so completely different (no vacation, overtime, tax, etc). I NEED a template of what a basic template will look like. I can't just go and pull something out of the air, because I will probably say things in there that make the contract void. Please, I know that it should only be a 2 page thing - I ended up with 5 pages of which 90% is probably unnecessary. I just can't believe that in a country where I could find everything else with ease and a couple of clicks, I can't find something as basic as a stupid employment agreement. I have 3 people jumping up and down, a ton of work and a child in need of attention.

But not to worry, she is going to take an AB contract, take the BC Employment Standards Act, change whatever is necessary and then we will submit that to the employer
